Terms of Use & End User License Agreement

These Terms of Use and End User License Agreement (the “Terms”) are a binding agreement between you and the operator of Pulse: Peace of Mind (“Pulse”, “we”, “us”). By creating an account or using Pulse, you agree to these Terms. If you do not agree, do not use Pulse.

Pulse is also licensed to you under Apple’s Licensed Application End User License Agreement (“Standard EULA”). These Terms supplement the Standard EULA; where they add requirements (such as the content rules below), the additional requirements apply.

Pulse is a wellness and peace-of-mind app — not a medical device, monitoring service, or emergency tool. It cannot detect medical events or emergencies, data may be delayed or unavailable, and you must not rely on it for safety. In an emergency, call your local emergency number.

1. Who can use Pulse

You must be at least 13 years old to use Pulse. By using Pulse you represent that you meet this requirement and that the information you provide is accurate. You are responsible for activity that occurs under your account.

2. What Pulse does

Pulse lets two people who each choose to connect share a small set of their own Apple Watch wellbeing signals (such as resting heart rate, sleep, and activity) and send each other short messages (“tap-backs”). Sharing is consent-based, per-metric, and revocable at any time. See our Privacy Policy for how data is handled.

3. User content and messaging

Pulse includes a free-text messaging feature. “User Content” means anything you submit, including messages and any text you enter. You are solely responsible for your User Content.

Zero tolerance for objectionable content and abusive behavior. There is no tolerance for objectionable, abusive, harassing, threatening, hateful, sexually explicit, or otherwise inappropriate content or behavior, or for abusive users. Accounts that violate this policy may be suspended or terminated without notice.

You agree that you will not use Pulse to create, send, or store User Content that:

By submitting User Content you grant us the limited right to store and transmit it solely to deliver the messaging feature, and to review, filter, or remove it to enforce these Terms.

5. Acceptable use

You agree not to misuse Pulse, including by attempting to access data you are not authorized to see, interfering with the service, reverse-engineering it except as permitted by law, or using it to surveil or harass any person. Sharing in Pulse is consensual by design; do not pressure anyone to share, and respect every person’s right to pause or stop sharing at any time.

6. Enforcement and termination

We may remove content and suspend or terminate accounts that violate these Terms, with or without notice. You may stop using Pulse and delete your account at any time from Settings → Account → Delete Account, which removes your data and revokes your Sign in with Apple token as described in the Privacy Policy.

7. Disclaimers and limitation of liability

Pulse is provided “as is” for general wellbeing and reassurance. To the fullest extent permitted by law, we disclaim all warranties and are not liable for any indirect or consequential damages, or for any reliance on Pulse for medical, safety, or emergency purposes. Nothing in these Terms limits liability that cannot be limited under applicable law.

8. Changes

We may update these Terms. For material changes we will update the date above and notify you in the app. Continued use after changes means you accept the updated Terms.
